    I just sold a car on November 16, 2008. Although I was mentioned to take the license plates and the notice of sale back, but I forgot to do so. I gave purchaser many calls to date him and take them back, but I could not meet him until November 20, 2008. He parked the car which he was trying to sale again to make some profit (because I sold it cheap) upon public property on November 18, 2008. And now, I received a letter from Lexena Municipal Court. The letter says:

    Read Carefully: Your Driver License May Be Suspended
    You have failed to respond to the citation described in this notice by appearing in court on Tuesday, December 02, 2008 AT 08:30 or paying the fine within the prescribed time limit. Failure to appear on:
    Tuesday, January 13, 2009 AT 08:30 AM
    or to pay the fine 24 hours prior to that time will result in a warrant being issued for your arrest and a notice to licensing authority in your state to suspend your drivers license. Many states, like the State of Kansas, require a reinstatement fee of $50.00 per citation in addition to any fine assessed.

    Do not mail cash. Payment may be made by check, money order or on-line at www.ci.lenexa.ks.us.



    Các bác làm ơn cho tớ hỏi vậy tớ phải làm thế nào? Cái thư trứoc nó gửi tới nhưng ko nhận đuợc hoặc nhận đuợc nhưng mà ai trong nhà tớ quẳng đâu rồi tớ ko tìm thấy. Vậy theo các bác bi giờ tớ phải làm gì? Nên ra tòa hay là trả phạt cho ngừoi kia? Nếu như tớ ko muốn ra tòa thì tớ trả phạt phải ko ạ?

    Trước tiên bạn cần phải gọi DMV xem xe này có chuyển qua tên người khác chưa. Nếu có thì xin giấy tờ chứng minh để trình lên tòa thì những tiền phạt trước sẽ được miễn vì chủ mới phải chịu.

    Thứ hai, nếu DMV cho thấy xe này vẫn còn nằm dưới tên bạn, thì bạn hãy gọi cảnh sát ngay lập tức và báo rằng chiếc xe này đã bị ăn cắp. Bắt buộc ngươi kia phải chịu liên lạc bạn và trả những phí tòa. Nếu thành công, sau đó gởi cho tôi một chi phiếu

    Dạ cảm ơn bác! Vậy tớ sẽ phải đi tới chỗ DMV và trình cái copy of title của xe. Sau đó trình bày như tớ đã nói à?

    I sold my car in November 16, 2008, but unfortunately I have forgotten to take the license plates out (you wanted to say about this consequence so you should use pp tense). After noticing my mistake I have tried to call the buyer several times to ask him about my license plates, and thanks GOD, I got it back in November 20, 2008. But during the meantime the buyer parked the car on a public place in November 18, 2008 which was 2 days after my car was sold. An now comes the problem: I was asked to pay for his mistake, what should I do? Should I pay that fee for him or what? I have no experience in this situation, could you help me out please?

    Khí tới DMV, cho họ cái bản sao của title và hỏi:

    Could you please tell me if this has been transferred out of my name yet? (Xin cho biết cái này đã được chuyển ra khỏi tên tôi chưa?)

    Nếu có thì xin họ in ra giấy chứng nhận và nếu họ hỏi mới cần trình bày.

    Nếu chưa thì xe vẫn thuộc về mình. Trong trường họp này tôi đề nghị gọi cảnh sát nhưng bạn trình bày và hỏi ý họ xem như thế nào.

    I went to DMV this morning, showed them the title and asked them for something has a date when I sold my car. But they said that they could not do anything for me.
    I will try to come again tomorrow, and do what you said. Let's see what happen. Hope it works.

    I think since the ticket was sent to you, chance that the ownership were switched, before the ticket, is possible but very unlikely.

    Here are a few things you should consider:

    1. If you signed the title over to the new owner, then it meant you had forfeit (give up) your ownership of the vehicle. This might be your only proof that the vehicle is no longer yours. (Did the buyer sign and date on the Nov 16th? Do you have the copy of the title after it was signed?).
    2. DO want to go to the police and explain the situation. Maybe they could help.
    3. DO NOT file a report on stolen vehicle. Falsify a police report is a crime. (You can’t sale a car then called it was stolen).
    4. DO show up on your court date and ask to speak to the DA (District Attorney). This person has the power to grant on your case (Do you have a clean driving record?). Explain your story. Make sure you bring proofs.
    • Since the ticket was issued in that town, the only way to settle the charge is for you to appear in court.

    The only thing that I have and can use as a proof at the court is the copy of notice of sale.
    I also have copy of title.
